Detention is always used as a last resort, and principally for youth who have committed serious offenses and are at risk to themselves or the community. Delinquent youth who are awaiting adjudication and disposition, or awaiting placement, or have violated the terms of their probation or parole, may be held up to 90 days. Federal mandate prevents unruly youth from being held in detention for any longer than 24 hours. Detention will not ordinarily be used for students who are truant or probationers who are suspended from school. Non-felony offenders may be detained, pending a detention hearing, when law enforcement officers identify serious risk to person or property, and the youth is approved by authorized court staff as meeting the admission criteria.
