Application process
Cases must be assigned to the Public Defender by the Cuyahoga County Court of Common Pleas (General Div.), Eighth District Court of Appeals or Cleveland Drug Court OR must be charged with a misdemeanor (must be a criminal offense) and have a case at the Cleveland Municipal Court. For misdemeanors under the Cleveland Municipal Court, walk in to the Municipal Division intake on the first floor M-F: 1:00pm-4:00pm for an intake interview. Those who cannot afford the fee may file an Affidavit of Poverty with the court. For other cases, phone M-F: 8:30am-4:30pm for information and an appointment.
Fee
Fixed application fee, which may be waived in some cases; may also have court costs.
Eligibility
Age 18 and older who cannot afford to pay for legal representation as determined by the court. Serves those with misdemeanor cases in the City of Cleveland and those with felony cases in Cuyahoga County.
