Application process

To Apply for a Name Change with the Summit County Probate Court: - Call the Name Change Department or visit the website for more information. A person seeking a change of name must file an application with the Court. An Applicant for a Name Change of an Adult or Minor or Name Conformity must live in Summit County for no less than sixty (60) days immediately prior to filing. Adult & Minor Name Change: The Applicant or an attorney, should prepare the correct documents and file them in the Court with the filing fee. Once the documents have been reviewed and approved by the Court, the Judgment Order will be sent to the Applicant. It is up to the Judge or Magistrate to decide if a hearing is held and if so, you will be notified of the hearing date. Minor Name Change only: A parent or guardian of a minor child may apply to change the name of a child. The parent(s) who is not the Applicant, must either consent to the change by signing a form or will be served by the court with notice of a hearing. If the parent is deceased, a photocopy of that parent’s death certificate must be provided. If a parent(s) whereabouts are unknown, see Affidavit Form CN.1, a hearing will be set. If consents from both parents are signed, the Judge or Magistrate will decide if a hearing is necessary and you will be notified of the hearing date. If no hearing is held, the applicant will receive the Judgment Order granting the change of name by mail. After Receiving a Certified Copy of the Summit County Probate Court Order: - Where the applicant seeking a legal change of name was born in the State of Ohio, the applicant may send a certified copy of the Probate Court Order legally changing his or her name to the Ohio Department of Health, Office of Vital Statistics. The applicant will receive an amendment to the certificate containing the new name and a statement that their records have been amended.

Fee

The present charge for filing for a Name Change is $125.00. This includes one certified copy of the order. Additional copies are $1.10.
